About

Andrew Kitzenberg testified for the prosecution on Day 33 about the early-morning April 19, 2013 confrontation on Laurel Street in Watertown. After hearing gunfire, he moved to his third-floor bedroom and photographed the scene because his attempted video was too dark to show recognizable details.

He described two men crouching behind a black SUV and returning to a green sedan for bags. He heard and felt two similar explosions and a larger third blast that shook his room, then saw the Mercedes make a U-turn and accelerate down Laurel Street. His account described both men's movements but did not identify the objects they handled, establish who was shooting, or attribute explosive-device throwing to either man.

During Steven D. Mellin's questioning about the departure route, Kitzenberg thought there was room to pass on the right of the green Honda and agreed there was room on the left. Government Exhibits 1523, 1524, and 1526, photographs from his observations, were admitted without defense opposition. Timothy G. Watkins noted that Exhibit 1524 was already admitted as Defendant's Exhibit 3006, declined questioning, and Kitzenberg was excused.
