Gary Oliveira testified on Day 50 as the deputy U.S. marshal who had monitored courthouse surveillance cameras while Dzhokhar Tsarnaev occupied cell 4 on July 10, 2013. During Nadine Pellegrini's direct examination, he authenticated Government Exhibit 1595, a still from a longer recording, as accurately representing what he saw live. He explained its timestamp and camera identifiers. The court admitted the photograph over a renewed defense objection and allowed either party to show the video.
On cross-examination, Miriam Conrad introduced three surveillance clips surrounding the still, admitted as Defense Exhibits 4000, 4001, and 4002. Oliveira confirmed that he had watched the incident live on a monitor and did not know why Tsarnaev made either gesture. He acknowledged a reflective camera surface but had not tested the reflection himself. He knew about a brace and facial injuries but did not know Tsarnaev had been shot in the face. The court restricted counsel's characterization of the footage, left its interpretation to the jury, and limited further injury questions to the scope of direct examination.
The defense also questioned how Oliveira documented the incident. During voir dire outside the jury's presence, he identified one report and clarified that it was submitted July 12 at a superior's direction, although he usually wrote reports the same day. On cross-examination, after initially expressing uncertainty, he agreed that he wrote it two days after the incident. He said he had immediately notified supervisors and believed someone subsequently spoke with Tsarnaev, but could not recall who or confirm a conversation in the later clip.
