Marc Fucarile testified for the prosecution on Day 51 about the explosions outside the Forum restaurant and their lasting physical consequences. Under William D. Weinreb's questioning, he identified himself and friends in video footage and recalled the blasts and immediate aid.
Fucarile described the immediate loss of his right leg, extensive burns requiring skin grafts, hearing loss and severe injuries to his left leg. He explained that infections and bone growth had required revisions to his amputation, while scarring and skin breakdown limited prosthetic use. He estimated that he had undergone surgical procedures in the high 60s, with another operation planned for May 5 and continuing uncertainty about whether his left leg could be saved.
His testimony also addressed retained fragments, including one in his right atrium, and treatment risks as they had been explained to him. The court admitted X-ray Exhibits 1608, 1609 and 1610 after Miriam Conrad referred to the defense's previously noted position without restating its grounds. Fucarile acknowledged limits in his recollection and identification during direct examination. The defense asked no questions.
In penalty-phase closing argument, Steven D. Mellin cited Fucarile's injuries, repeated operations and retained shrapnel as part of the prosecution's argument concerning grave risk of death and serious physical abuse. Those statements were counsel's argument about the evidence, not additional testimony by Fucarile.
