About
Philip Christiana testified for the prosecution on Day 36 about an April 19, 2013 hazard sweep and evidence recovery at 69A Carriage Drive in New Bedford. The FBI special agent and bomb technician identified the apartment as the residence of Dias Kadyrbayev and Azamat Tazhayakov, friends of the defendant. He explained that he and Special Agent Scott were assigned to assist the Hostage Rescue Team and sweep for hazards after the tactical team cleared the apartment of people.
Christiana described seizing a Sony VAIO laptop from the dining table and an iPhone from a bedroom believed to be Kadyrbayev's room. Two other phones were also recovered. He also described documenting the laptop's transfer to another agent. His photographic identification had limits: he took the first two photographs but could not definitively identify the exterior photograph as the apartment. Three apartment photographs were admitted without objection.
When Miriam Conrad objected to a question describing the iPhone as seized from Kadyrbayev, the judge required the prosecutor to rephrase it. The court admitted the laptop and iPhone as physical objects only, not their data. The defense declined cross-examination.
