He described impaired hearing, hot debris, cuts and burns, and severe injuries within his group. His testimony addressed the blast's effects rather than identifying who placed the device.
During Nadine Pellegrini's direct examination, Kilgore authenticated three videos he had made. Exhibit 11A showed the scene before the blast; Exhibits 11B and 11C recorded its aftermath. The court admitted and played the recordings, with 11B and 11C subject to an earlier ruling. Kilgore identified people in the videos and in a displayed photograph, Exhibit 8, and explained that recording was a reflex developed through years of camera use.
Kilgore described helping injured relatives, responders using his belt as a tourniquet for Gina, and accompanying her toward an ambulance. He later received treatment for a perforated eardrum and other injuries, then worked with his wife to locate family members at hospitals. The defense declined questioning, and he was excused.
In a penalty-phase discussion, the court indicated that sound accompanying Exhibit 11B was probably admissible despite defense objections concerning prejudice and relevance to aggravating factors. The court rejected the defense's position that grave risk of death should be assessed solely when the act occurred, explaining that attending consequences helped explain the act.
