MR. WEINREB: Good morning, Mr. Henneberry.
DAVID HENNEBERRY: Good morning.
MR. WEINREB: Where do you live?
DAVID HENNEBERRY: Watertown.
MR. WEINREB: How long have you lived there?
DAVID HENNEBERRY: All my life, basically.
MR. WEINREB: Did you go to school in Watertown?
DAVID HENNEBERRY: Yes, I did.
MR. WEINREB: Where did you go?
DAVID HENNEBERRY: Watertown High.
MR. WEINREB: What's your part of Watertown like?
DAVID HENNEBERRY: Quiet but busy at the same time, you know. It's quiet, basically.
MR. WEINREB: So mostly families or businesses?
DAVID HENNEBERRY: Families.
MR. WEINREB: And what are the homes like? Are they single-family homes, apartment buildings?
DAVID HENNEBERRY: Single-family and double -- two-family homes, I would say.
MR. WEINREB: Do you work?
DAVID HENNEBERRY: No, I'm retired.
MR. WEINREB: Where did you work?
DAVID HENNEBERRY: Phone company. Telephone company.
MR. WEINREB: In April 2013, did you own a boat?
DAVID HENNEBERRY: I did.
MR. WEINREB: What kind?
DAVID HENNEBERRY: A 1981 SeaBird, it's called.
MR. WEINREB: What kind of -- what powers that boat?
DAVID HENNEBERRY: The V8 engine, inboard.
MR. WEINREB: What's an inboard engine?
DAVID HENNEBERRY: It's mounted inside the boat. It's in the middle of the boat, and it's a V8 motor like a car.
MR. WEINREB: When you say it's mounted inside the boat, what portion of the boat, if you were just looking at it from the side, would it be in?
DAVID HENNEBERRY: Oh, in the middle.
MR. WEINREB: And is it, like, above the level of the floor of the boat or is it sunk below it?
DAVID HENNEBERRY: A good portion is above.
MR. WEINREB: It's raised up?
DAVID HENNEBERRY: Yes.
MR. WEINREB: And is it encased in something?
DAVID HENNEBERRY: Yes, it is. It's encased in a heavy Fiberglas cover.
MR. WEINREB: Now, did you use the boat? Did you use the boat when you --
DAVID HENNEBERRY: Oh, yeah.
MR. WEINREB: A lot?
DAVID HENNEBERRY: Oh, yeah. Yeah.
MR. WEINREB: And did you use it in the winter?
MR. WEINREB: So what would you do with it in the winter?
DAVID HENNEBERRY: I'd have it towed into the yard and I'd shrink-wrap it -- have it shrink-wrapped and basically put it away for the winter in the yard.
MR. WEINREB: What yard?
DAVID HENNEBERRY: My own backyard.
MR. WEINREB: In addition to having it shrink-wrapped, did you put anything else on it to protect it from the elements?
DAVID HENNEBERRY: I put chafing guards on the shrink-wrap and put a door in it -- a zipper door that I could check on its condition when I wanted.
MR. WEINREB: What are chafing guards?
DAVID HENNEBERRY: We have the -- around the hull where the strap -- just like a paint roller.
MR. WEINREB: So that you put paint rollers underneath the shrink-wrap?
DAVID HENNEBERRY: On a main strap that holds it, yeah. So against the hull. So it doesn't scratch the hull, yeah.
MR. WEINREB: You said something about a zipper door?
DAVID HENNEBERRY: There was a zipper door that --
MR. WEINREB: What did that let you do?
DAVID HENNEBERRY: It gave me access to the inside of the boat. If I wanted to get in, there was plenty of room to get in the boat, work around.
MR. WEINREB: Where was your boat on April 19th, 2013?
DAVID HENNEBERRY: In the backyard.
MR. WEINREB: Was it all shrink-wrapped as you described?
DAVID HENNEBERRY: Yes, it was.
MR. WEINREB: Do you recall the events of April 19, 2013?
DAVID HENNEBERRY: I do.
MR. WEINREB: What happened?
DAVID HENNEBERRY: From...
MR. WEINREB: You woke up on the morning of April 19th. Did you have some coffee?
DAVID HENNEBERRY: Yup, and we got the call of shelter-in-place. And we were looking out the window during the day, and the activity -- the police activity. And we just sheltered in place. I...
MR. WEINREB: Did you notice anything unusual about your boat?
DAVID HENNEBERRY: Well, I did. One of the -- as mentioned, the chafing guards -- two of them had fallen down from the boat, and the shrink-wrap itself looked a little loose but I couldn't tell cause I didn't go out there, so...
MR. WEINREB: When was the last time you had looked at the boat?
DAVID HENNEBERRY: I see it every day.
MR. WEINREB: So the last time you'd seen it before you'd woken up that morning, were the chafing guards on the ground?
MR. WEINREB: Was the shrink-wrap loose the last time you had looked at it before the morning of April 19th?
DAVID HENNEBERRY: It was fine, yeah.
MR. WEINREB: So when you woke up in the morning and you saw that thing didn't look normal, did you go right out and investigate?
DAVID HENNEBERRY: No, because we had to shelter in place. I didn't want to be in the backyard.
MR. WEINREB: Did you eventually go out to investigate?
DAVID HENNEBERRY: When they called it off at about six o'clock.
MR. WEINREB: 6 p.m.?
DAVID HENNEBERRY: Yes.
MR. WEINREB: What did you do then?
DAVID HENNEBERRY: I said, "I'm going to go out and see what's going on," put the pads back up. Simple. And I just thought it was -- had come loose in the wind. And --
MR. WEINREB: Can you just reach up there or did you need to use something to help you get up there?
DAVID HENNEBERRY: It's only chest high, this particular part. To get into the boat, I need a ladder.
MR. WEINREB: So what happened when you went out and checked it out?
DAVID HENNEBERRY: Well, I went and got the ladder and I put it up, and rolling -- I have two doors. I have a plastic door and one made of shrink-wrap that I could roll up. It's like a storm door, I call it. And I put the ladder up and I went to check on the boat and basically see why the strap was loose, and I noticed a lot of blood.
MR. WEINREB: Where did you see the blood?
DAVID HENNEBERRY: On the deck of the boat inside.
MR. WEINREB: Had that blood been there when you had put the shrink-wrap on?
MR. WEINREB: Was it like a pool of blood?
DAVID HENNEBERRY: Not a pool. It was like if somebody got a bad cut and dripping, smudge. But not a huge amount, but enough, yeah.
MR. WEINREB: So what did you do when you saw that blood?
DAVID HENNEBERRY: I just -- looking at it. I'm standing on the ladder and I'm looking in the door and I'm, just, "Where's it coming from?" And I followed it down, and along the sides, and more blood up forward on the boat. And I think I -- I don't know how long. I just kept fixating on this blood. And then I just -- my eyes looked at the other side of the boat and that's when I saw a body in the boat, let's say.
MR. WEINREB: Where was the body in relation to the inboard motor you described earlier?
DAVID HENNEBERRY: It was on the other side from the -- of the inboard motor, and laying on the deck on the other side.
MR. WEINREB: What part of the person could you see?
DAVID HENNEBERRY: I could see his boots, or shoes, black; I could see his pants. I think they were work-type pants. A hooded sweatshirt, dark color, pulled up over his head; back toward me, facing the other way.
MR. WEINREB: So lying on his side?
DAVID HENNEBERRY: Lying on his side, correct.
MR. WEINREB: When you looked at him, was he moving around or was he still?
DAVID HENNEBERRY: No movement at all.
MR. WEINREB: What did you do then?
DAVID HENNEBERRY: I took it in for a split second and I got off the ladder pretty quick and went in the house. And my wife knew something was wrong and handed me the phone and I called 9-1-1.
MR. WEINREB: I'd like to show you a couple of photos.
DAVID HENNEBERRY: Okay.
MR. WEINREB: If we could have Exhibit 798, please, just for the witness.
MR. WEINREB: Do you recognize that?
DAVID HENNEBERRY: My house.

DAVID HENNEBERRY: Yes, it is.
MR. WEINREB: And there appears to be a driveway on either side of it?
DAVID HENNEBERRY: Correct.
MR. WEINREB: Which is your driveway?
DAVID HENNEBERRY: The one with the car in it, right there.
MR. WEINREB: So the one on the left?
DAVID HENNEBERRY: Yes.
MR. WEINREB: If you walked down that driveway, what does it lead to?
DAVID HENNEBERRY: My boat. Backyard and the boat.
MR. WEINREB: Can we have Exhibit 804, please, just for the witness, and then 806. Actually, hold on that.
MR. WEINREB: Do you recognize this?
DAVID HENNEBERRY: The boat.
MR. WEINREB: And do you see something leaning up against the boat?
DAVID HENNEBERRY: That's my ladder.
MR. WEINREB: Is this a fair and accurate picture of how the boat looked that night, the night of April 19th at some point?
DAVID HENNEBERRY: Later in the night, after the -- you know, the incident, let's say.
MR. WEINREB: And so this was after the person came out of the boat?
DAVID HENNEBERRY: Yes, correct.
MR. WEINREB: And then 806, please.
MR. WEINREB: What's that a picture of?
DAVID HENNEBERRY: That's my backyard, my stone wall.
MR. WEINREB: And the portion that's not your backyard or that's on the other side of the stone wall, what's that?
DAVID HENNEBERRY: That's my neighbor's driveway.
MR. WEINREB: Is that a fair and accurate picture?
DAVID HENNEBERRY: Yes, it is.

MR. WEINREB: So we'll start with 806, please. Just leave that there. So you said that to the right of the stone wall is your neighbor's driveway?
DAVID HENNEBERRY: Yes.
MR. WEINREB: And it seems to lead to a white structure in the back?
DAVID HENNEBERRY: Neighbor's garage.
MR. WEINREB: To the left of that we see another white structure?
DAVID HENNEBERRY: My garage.
MR. WEINREB: Do you see the boat?
DAVID HENNEBERRY: Right.
MR. WEINREB: Could you -- if you -- that screen in front of you, it's touch-sensitive.
DAVID HENNEBERRY: Okay.
MR. WEINREB: If you push the pad of your finger sort of hard, you can circle things. Can you circle your boat?

DAVID HENNEBERRY: Yes.

DAVID HENNEBERRY: That's the shrink-wrap. It's ripped up and torn down.
MR. WEINREB: So I've circled what appears to be some plastic material?
DAVID HENNEBERRY: That's a piece of the door. That's clear plastic.
MR. WEINREB: On the left side of the photo?
DAVID HENNEBERRY: Yeah.
MR. WEINREB: Now can we have Exhibits 8 -- well, we'll start with 801 for the witness.
MR. WEINREB: Do you recognize that?
DAVID HENNEBERRY: I do.

MR. WEINREB: Was -- and you see some police tape on your yard?
DAVID HENNEBERRY: I do.

DAVID HENNEBERRY: Yeah. Yeah, I would say yes.
MR. WEINREB: Does it appear to be a fair and accurate photo of what it liked like --
DAVID HENNEBERRY: Yes.

MR. WEINREB: So now we're showing it to the jury and I'm going to ask you some questions about it. So looking at the boat from this perspective, where's the cameraman standing?
DAVID HENNEBERRY: He would be standing in the neighbor's driveway.
MR. WEINREB: The boat appears to be up against a fence on the left. Is that right?
DAVID HENNEBERRY: Not -- yes, with space in between.
MR. WEINREB: So not touching it but near it?
DAVID HENNEBERRY: This much space (indicating).
MR. WEINREB: So you said "this much" and you put your hands a few feet apart. Is that correct?
DAVID HENNEBERRY: Yes.
MR. WEINREB: Is that where it was when you went out there to -- when you first noticed that something was wrong with it and you later went out to check it?
DAVID HENNEBERRY: Yes.
MR. WEINREB: 802, please.
MR. WEINREB: Is this just a closer-up photo of the boat?
DAVID HENNEBERRY: Yup.

MR. WEINREB: And the person who you saw, were they on the side of it closer to the fence or the side of it closer to the neighbor's driveway?
DAVID HENNEBERRY: The fence.
MR. WEINREB: Is that engine block solid metal?
DAVID HENNEBERRY: No; it's Fiberglas.
MR. WEINREB: The covering is Fiberglas?

MR. WEINREB: I'm going to circle a -- first of all, do you recognize where this is taken?
DAVID HENNEBERRY: In the berth. In the forward berth of the boat.
MR. WEINREB: And do you see the tip of a pencil that I've just circled in red?
DAVID HENNEBERRY: I do.
MR. WEINREB: I'm going to show you Exhibit 823. Does that appear to be a close-up of the same pencil?
DAVID HENNEBERRY: It is.
MR. WEINREB: And does there appear to be blood on the tip of the pencil?

DAVID HENNEBERRY: Fore.
MR. WEINREB: And for us non-nautical people, fore is the front of the boat?
DAVID HENNEBERRY: The front of the boat.
MR. WEINREB: And this, what I'm circling right here which appears to be the tip of a pencil, is that the pencil you identified earlier?
DAVID HENNEBERRY: It is.
MR. WEINREB: 823, please.
MR. WEINREB: And again -- I'm going to get that arrow out of the way -- I circled the tip of the pencil. Is this what you said has apparent blood on it?
DAVID HENNEBERRY: Yes.
MR. WEINREB: When that pencil -- when you wrapped up the boat, was there blood on the tip of that pencil?

MR. WEINREB: Okay. Once more, the writing and the blood you see there was not there when you wrapped up the boat for the winter?
DAVID HENNEBERRY: No, it was not.
MR. WEINREB: Now I want to draw your attention to this which appears to be a wooden slat screwed into the side of the boat just to the right of the writing near the bottom of the picture.
DAVID HENNEBERRY: Correct.
MR. WEINREB: Is that a part of the boat?
DAVID HENNEBERRY: Yes, it is.
MR. WEINREB: And when you wrapped up the boat for the winter, was that slat -- did that have any writing carved into it?
MR. WEINREB: 1450 for the witness, please.
MR. WEINREB: Do you see those same slats there?
DAVID HENNEBERRY: I do.
MR. WEINREB: All right. Do you see that there appears to be writing carved into them?
DAVID HENNEBERRY: I do.
MR. WEINREB: And again, that writing wasn't there when you wrapped up the boat for the winter?
DAVID HENNEBERRY: No, it was not.
MR. WEINREB: Is that, though, a fair and accurate picture of where the slats are in the boat?
DAVID HENNEBERRY: Yes, sir.

MR. WEINREB: Now, here there appears to be -- you can see writing all along the length of both boards. Is that correct?
DAVID HENNEBERRY: Correct.
MR. WEINREB: Does it appear to say "Stop killing our..." and then there's an arrow pointing downwards "...innocent people and we will..." and then there's an arrow pointing up "...stop"?
DAVID HENNEBERRY: Correct.
MR. WEINREB: None of that was there when you wrapped up the boat?

CROSS-EXAMINATION BY MR. WATKINS:
MR. WATKINS: Good morning, Mr. Henneberry.
DAVID HENNEBERRY: Good morning.
MR. WATKINS: Tim Watkins. I'm one of Jahar Tsarnaev's attorneys. Mr. Weinreb showed you a number of photos from April 20th which was after the -- what you call the incident?
DAVID HENNEBERRY: Uh-huh.
MR. WATKINS: And you went out and looked at the carnage of your boat afterwards?
DAVID HENNEBERRY: Not afterwards. I wasn't allowed out there.
MR. WATKINS: Oh, I see. But you've looked at these pictures before and you know what your boat looks like afterwards?
DAVID HENNEBERRY: Basically. I just saw them from the prosecutor.
MR. WATKINS: So could this just be for the witness, your Honor?
MR. WATKINS: I'm going to show you some pictures here. Do you recognize this?
DAVID HENNEBERRY: I do.
MR. WATKINS: And what is that?
DAVID HENNEBERRY: My boat.
MR. WATKINS: Now, is that the way your boat looked after the incident?
DAVID HENNEBERRY: After, yes.
MR. WATKINS: Is that a fair and accurate representation of the back of it?
DAVID HENNEBERRY: I never saw the back.
MR. WATKINS: I see. When Mr. Weinreb showed you some pictures, did you -- you were able to recognize those pictures from April 20th?
DAVID HENNEBERRY: No, I can recognize them from now. I wasn't at the boat. I wasn't allowed back there.
MR. WATKINS: So -- but this is your boat?
DAVID HENNEBERRY: It is my boat.
MR. WATKINS: And it has, you see, holes in it, in the back. Those weren't there before April 20th. Is that right?
MR. WATKINS: And there are other markings here. That red blood stain -- that red-brown stain was not there before April 20th?
DAVID HENNEBERRY: Not before, yeah.
MR. WATKINS: So that is a fair and accurate -- beyond those additions, that is the way your boat looked?
DAVID HENNEBERRY: Yeah, I guess. Like I say, I never saw this in person afterwards. I never saw it afterwards.

MR. WATKINS: And directing your attention -- directing your attention here, the red-brown stains that you see there, were those on the boat prior to the incident on April 19th?
