ProceduralProc.Mercedes-Benz Stipulation and Admission of Wallet Contents

MR. MELLIN: Your Honor, two other housekeeping matters. I believe Ms. Clarke is going to join me at some point. First, we have a stipulation. The parties hereby stipulate and agree that the 2013 Mercedes-Benz ML350 with the vehicle identification number 4JGDA5HB1DA193885 was manufactured in Tuscaloosa, Alabama, and shipped to Herb Chambers Mercedes-Benz of Boston, 295 McGrath Highway, Somerville, Massachusetts, in February 2013. Herb Chambers Mercedes-Benz subsequently leased that vehicle to Dun Meng on or about March the 5th of 2013. That is that stipulation, your Honor.

The other is the contents of the wallet, and I believe Ms. Clarke wants to show a few photographs. The wallet and the contents are marked as Exhibit 1561.

MS. CLARKE: Your Honor, these were exhibits that a witness did not have with him when we talked about it and the government agreed to bring them so we could show them to the jury, and there are some pictures that do it.

If I could ask Mr. Bruemmer to call up 920-01 for everybody to see. The government is stipulating.

THE COURT: I thought it was just the exhibit without the indexing. There it is. Okay.

(Pause.)

MS. CLARKE: If we could take it down for just a moment. I think we have some questions about some numbers.

THE COURT: While this is happening, let me just say to the jury that a -- one source of evidence in a case like this can be a stipulation by the parties, which means the parties agree that certain facts may be taken as true by you; there's no controversy about them. That's what this is. The parties are stipulating to some facts that you can take as established.

(Counsel confer off the record.)

MS. CLARKE: Your Honor, I believe what we'd like shown to the jury is 948-563. This is the --

THE COURT: Is that what's on the screen?

MS. CLARKE: Yes.

This is the contents of the wallet that was found in the back of the Honda Civic, the back behind the driver's seat in the Honda Civic. The wallet was identified as having papers belonging to Tamerlan Tsarnaev, his identification and credit cards. So we'll show 563 as the full contents and the jury will have the full contents.

The next picture is 94-571.

THE COURT: I take it it's 948-571?

MS. CLARKE: Yes. And if Mr. Bruemmer could enlarge the purchase -- the item purchased.

The next photograph, your Honor, is 948-572. That was what was just enlarged.

The next photograph is another receipt, 948-573. If Mr. Bruemmer could enlarge...

The next photograph is 948-574. If Mr. Bruemmer could enlarge...

The next photograph, your Honor, is 948-575. If Mr. Bruemmer could enlarge...

The next photograph, your Honor, is 948-576. I believe we have a couple more photographs that show the sections of that maybe better: 948-577, 948-578, 948-579. If Mr. Bruemmer could enlarge the center section.

Thank you, your Honor. I would move in 1561 and the photographs that were just shown to the jury.

THE COURT: 1561 is the physical items?

MS. CLARKE: The physical items, yes.

MS. CLARKE: Thank you.

(Defense Exhibit No. 1561 received into evidence.)

(Pause.)

MR. WEINREB: We're also waiting for one of the attorneys.

(Pause.)

MR. WEINREB: Your Honor, the United States calls Christian Fierabend.
