DIRECT EXAMINATION BY MR. WEINREB:

MR. WEINREB: Good morning, Mr. Lakkis.

EDDIE LAKKIS: Good morning.

MR. WEINREB: How old are you?

EDDIE LAKKIS: Twenty-six.

MR. WEINREB: Where do you work?

EDDIE LAKKIS: Memorial Drive Mobil.

MR. WEINREB: How long have you worked there?

EDDIE LAKKIS: Five years.

MR. WEINREB: Where is -- where on Memorial Drive is the Memorial Drive Mobil station?

EDDIE LAKKIS: Intersecting with River Street.

MR. WEINREB: And what's your job?

MR. WEINREB: What does that mean? What do you do?

EDDIE LAKKIS: In charge of daily operations, IT and security.

MR. WEINREB: What does "IT" stand for?

EDDIE LAKKIS: Information technology: the servers, dispensing equipment, cash registers.

MR. WEINREB: Surveillance cameras?

EDDIE LAKKIS: And surveillance cameras, yes.

THE COURT: Mr. Lakkis, will you pull the microphone closer to you just so you're speaking more directly into it?

THE COURT: Thank you.

EDDIE LAKKIS: You're welcome.

MR. WEINREB: Mr. Bruemmer, may we have Exhibit 742, please.

BY MR. WEINREB:

MR. WEINREB: Could you take a look at the screen in front of you?

MR. WEINREB: Do you recognize what that is?

EDDIE LAKKIS: Yes; that's the intersection where we're at, and the Shell is right across the street.

MR. WEINREB: Could you circle the Mobil station?

EDDIE LAKKIS: (Witness complies.)

MR. WEINREB: Let the record reflect that the witness has drawn a circle around the dot that's labeled "Mobil station" that's just -- it's below River Street on the diagram and just to the right of Memorial Drive.

May we have 745, please?

MR. WEINREB: Do you recognize that?

EDDIE LAKKIS: Yeah, that's the Mobil station.

MR. WEINREB: Where is this picture being taken from?

EDDIE LAKKIS: From the Shell station.

MR. WEINREB: Exhibit 751, please.

MR. WEINREB: What's that a picture of?

THE COURT: Not admitted.

MR. WEINREB: Oh, I'm sorry. This is a different witness.

MR. WEINREB: What's that a picture for?

EDDIE LAKKIS: The Mini Mart.

MR. WEINREB: Is that part of the Mobil station?

MR. WEINREB: Is that a fair and accurate picture?

MR. WEINREB: The government offers 751.

MS. CLARKE: No objection.

BY MR. WEINREB:

MR. WEINREB: Mr. Lakkis, if you don't mind, could you circle the entrance to the Mobil mart?

EDDIE LAKKIS: Sure (indicating).

MR. WEINREB: What is the Mobil mart?

EDDIE LAKKIS: A convenience store.

MR. WEINREB: How many security cameras does the station have?

MR. WEINREB: Are there any that are inside the Mobil mart?

MR. WEINREB: In the course of your work as manager, do you sometimes look at the video from the surveillance cameras?

EDDIE LAKKIS: All the time.

MR. WEINREB: Do the cameras take accurate video?

MR. WEINREB: Do the recordings that the cameras make have a date and timestamp?

MR. WEINREB: Are those accurate?

MR. WEINREB: Did you go to the station shortly after midnight on April 18, 2013?

EDDIE LAKKIS: I was called down by Cambridge police.

MR. WEINREB: What happened when you got there?

EDDIE LAKKIS: The station was taped off. I got in there and I was asked to pull the video off the DVR.

MR. WEINREB: Did you pull surveillance video from all the interior cameras?

MR. WEINREB: Did you review it at the time you pulled it?

MR. WEINREB: Exhibit 752 just for the witness, please.

MR. WEINREB: This is the first frame of a video. I'm just going to play some portion of it for you.

(Video played.)

MR. WEINREB: Do you recall viewing this in my office not long ago?

MR. WEINREB: Is this a composite of video from several different video cameras?

EDDIE LAKKIS: Yes. This video, yes.

MR. WEINREB: Other than the clips in the very beginning which -- do you know where those are taken from?

EDDIE LAKKIS: The Shell station.

MR. WEINREB: Is the video portion of this exhibit a fair and accurate copy of what you provided to the police that night?

MR. WEINREB: I have no further questions at this time.

MS. CLARKE: No questions. Thank you.

THE COURT: All right. Thank you, Mr. Lakkis. You may step down.

EDDIE LAKKIS: Thank you.
