DIRECT EXAMINATION BY MR. WEINREB:
MR. WEINREB: Good afternoon, Mr. Homol.
GREGORY HOMOL: Good afternoon.
MR. WEINREB: Where do you work?
GREGORY HOMOL: At UMass Dartmouth.
MR. WEINREB: At what part?
GREGORY HOMOL: I'm the director of the fitness center.
MR. WEINREB: What's your job at the UMass Dartmouth Fitness Center?
GREGORY HOMOL: I am the director.
MR. WEINREB: How long have you been the director?
GREGORY HOMOL: Fifteen years.
MR. WEINREB: What are your job responsibilities there?
GREGORY HOMOL: Overall management of the facility, day-to-day operations. I supervise professional staff, work study students, aerobics instructors. And I oversee our strength and conditioning program for the Athletic Department.
MR. WEINREB: Who's allowed to used the fitness center at UMass Dartmouth?
GREGORY HOMOL: Students, faculty, staff, alumni, and employee family members.
MR. WEINREB: Can they use it more or less whenever they want?
GREGORY HOMOL: Yes.
MR. WEINREB: How do you limit use to the people who are allowed to use it?
GREGORY HOMOL: We don't limit use.
MR. WEINREB: What I mean is how do you prevent just random people from walking in off the street and using it?
GREGORY HOMOL: Okay. We have a check-in, a card check-in system. When a person comes in, the first thing they do is they swipe in.
MR. WEINREB: So they have some kind of UMass Dartmouth issued ID?
GREGORY HOMOL: Yes. It's a key tag, barcoded.
MR. WEINREB: What does it mean to swipe in?
GREGORY HOMOL: There's an eye, an electronic eye, that they put the card in front of. When it does that, it triggers our system to pull up the member's profile basically with a picture and their standing. If they're in good standing, they're able to use the facility.
MR. WEINREB: Does the system store the swipe data?
GREGORY HOMOL: Yes.
MR. WEINREB: Does it store the date and time that each particular person swiped in?
GREGORY HOMOL: Yes.
MR. WEINREB: By their name?
GREGORY HOMOL: Yes.
MR. WEINREB: During your 15 years as director of the fitness center, have there been times when you've had to pull up swiped data?
GREGORY HOMOL: Yes.
MR. WEINREB: How many times?
GREGORY HOMOL: Many times.
MR. WEINREB: To the best of your knowledge, have the data been accurate?
GREGORY HOMOL: Yes.
MR. WEINREB: Are there also security cameras at the fitness center?
GREGORY HOMOL: Yes, there are.
MR. WEINREB: Where are they located?
GREGORY HOMOL: At the -- at that time we had two: one behind the reception desk and one pointing down the main hallway.
MR. WEINREB: Again, during your 15 years as director of the fitness center, have there been times when you had to review surveillance video?
GREGORY HOMOL: Yes.
MR. WEINREB: To the best of your knowledge, has the video been accurate?
GREGORY HOMOL: Yes.
MR. WEINREB: Do you remember the morning of April 19, 2013?
GREGORY HOMOL: Yes, I do.
MR. WEINREB: What happened that morning?
GREGORY HOMOL: It was kind of a quiet morning. There was news that something had gone on with the bombing suspects, and so we had the television on.
MR. WEINREB: Just to be clear, the bombing itself had taken place on April 15th?
GREGORY HOMOL: Correct.
MR. WEINREB: So that was about five days earlier?
GREGORY HOMOL: Yes.
MR. WEINREB: And you heard something had happened with the suspects?
GREGORY HOMOL: Yes.
MR. WEINREB: Please continue.
GREGORY HOMOL: Somebody -- a coworker had come in and said that one of the suspects was a student, and I had instructed that person to not spread rumors, that we have no knowledge of that, that, you know, let's not cause any rumors getting spread out. I had my work study student who was sitting at the desk just punch in a name; and when he did, the profile popped up that, in fact, it was a student.
MR. WEINREB: So a student at UMass Dartmouth?
GREGORY HOMOL: Yes.
MR. WEINREB: Can we have Exhibit 1180H5 just for the witness, please?
MR. WEINREB: If you could look at the screen in front of you, do you recognize what that is?
GREGORY HOMOL: Yes. That's one of the reports from my system.
MR. WEINREB: Is that swipe data --
GREGORY HOMOL: Yes.
MR. WEINREB: -- that you were describing? To the best of your knowledge, is that accurate data?
GREGORY HOMOL: Yes, it is.
MR. WEINREB: The government offers Exhibit 1180H5.

MR. WEINREB: If you could look at the second name up from the bottom, does that say "Jahar Tsarnaev"?
GREGORY HOMOL: Yes.
MR. WEINREB: And when does it indicate that he -- does he indicate that he swiped into the fitness center at a particular date and time?
GREGORY HOMOL: It does.
MR. WEINREB: What date and what time?
GREGORY HOMOL: March 16, 2013, at 9:05 p.m.
MR. WEINREB: Just so the record is clear, you said "March," but there's a "4" there.
GREGORY HOMOL: I'm sorry. April 16th.
MR. WEINREB: Now, this particular swipe system, they don't have to swipe out, is that correct?
GREGORY HOMOL: Correct.
MR. WEINREB: But the surveillance camera system, would that -- if you saw the same person go out who would come in, would that let you know when they had come out?
GREGORY HOMOL: Yes.
