STEVEN A. KIMBALL: Yes, sir. Steven A. Kimball, K-i-m-b-a-l-l.

DIRECT EXAMINATION BY MR. CHAKRAVARTY:

MR. CHAKRAVARTY: Good afternoon. Where are you employed?

MR. CHAKRAVARTY: Where are you employed? Excuse me.

STEVEN A. KIMBALL: With the FBI office in Boston.

MR. CHAKRAVARTY: Are you an FBI special agent?

MR. CHAKRAVARTY: How long have you been an agent?

STEVEN A. KIMBALL: Approximately ten years.

MR. CHAKRAVARTY: What different -- have you worked in different field offices?

STEVEN A. KIMBALL: Yes. I worked in the Newark FBI office. I've also worked out of our headquarters components.

MR. CHAKRAVARTY: Back in April of 2013, were you assigned to the Boston Field Division?

MR. CHAKRAVARTY: As part of your roles as an agent, did you participate in the Boston Marathon investigation?

MR. CHAKRAVARTY: In fact, after the Boston Marathon explosions that occurred, was the entire field office mobilized to respond?

MR. CHAKRAVARTY: In the days after the Boston Marathon bombing, was a command post set up at the Boston field office headquarters?

MR. CHAKRAVARTY: Can you describe generally what the atmosphere was there?

STEVEN A. KIMBALL: Basically, we had a lot of government agencies from across the state and region that were centered on the eighth floor and tried to coordinate the effort as far as the investigative effort, in reaction to the bombings.

MR. CHAKRAVARTY: Now, after the suspects were identified --

MR. CHAKRAVARTY: -- were there internet searches to determine whether those individuals had any social media accounts?

STEVEN A. KIMBALL: Yes, there was.

MR. CHAKRAVARTY: Were certain social media accounts actually identified?

STEVEN A. KIMBALL: Yes, there was.

MR. CHAKRAVARTY: Was there particularly a Twitter account that was associated with Jahar Tsarnaev?

STEVEN A. KIMBALL: Yes, there was.

MR. CHAKRAVARTY: How did you discover that?

STEVEN A. KIMBALL: That was discovered in the morning hours after reviewing essentially open-source media and also receiving tips from the public.

MR. CHAKRAVARTY: Do you remember the handle that was used by Jahar Tsarnaev for his --

MR. CHAKRAVARTY: At some point later, was there another Twitter account associated with the defendant?

STEVEN A. KIMBALL: Yes, there was.

MR. CHAKRAVARTY: What was that called?

STEVEN A. KIMBALL: Al_FirdausiA.

MR. CHAKRAVARTY: How did you find that?

STEVEN A. KIMBALL: That was basically found -- essentially, it was connected to that account from -- they basically were linked together because they were essentially following each other, is the best way to explain it.

MR. CHAKRAVARTY: Now, as part of your role in the investigation, at some point later, did you apply for search warrants?

MR. CHAKRAVARTY: And part of some of those search warrants -- were there dozens of search warrants that you applied for for various different things?

MR. CHAKRAVARTY: Were some of the search warrants for these Twitter accounts?

MR. CHAKRAVARTY: The Twitter account under the name J_tsar and the Twitter account for the name Al_FirdausiA?

MR. CHAKRAVARTY: Did you -- did the FBI receive results of those search warrants?

STEVEN A. KIMBALL: Yes, they did.

MR. CHAKRAVARTY: Are Twitter accounts available for the public to view without a search warrant?

STEVEN A. KIMBALL: Yes, in most cases, yes.

MR. CHAKRAVARTY: Can you just explain for the, jury for those who don't have their own Twitter account, just how Twitter works a little bit?

STEVEN A. KIMBALL: Twitter is basically a public messaging system where someone creates an account with a user name and a display profile, and they can post information to the internet and share that information with other like-minded users who want to share that information.

MR. CHAKRAVARTY: With regards to the J_tsar Twitter account, did -- when the Twitter provided records related to that account, did it provide subscriber information for that account?

MR. CHAKRAVARTY: I'm going to ask Mr. Bruemmer to pull up just for the witness and the Court Exhibit 1264. Excuse me. Sorry. 1274.

MR. CHAKRAVARTY: Is this the subscriber information for the J_tsar account?

MR. CHAKRAVARTY: Is the subscriber information for the Al_FirdausiA account?

MR. CHAKRAVARTY: I'd move 1264 and 1274 into evidence.

MR. CHAKRAVARTY: Could we just publish, please, your Honor?

MR. CHAKRAVARTY: Agent Kimball, after you received the response from Twitter with regards to the contents of each of these accounts, can you compare them with the data that had been collected through just publicly browsing to those two Twitter accounts?

MR. CHAKRAVARTY: And did they compare favorably?

STEVEN A. KIMBALL: Yes, they did.

MR. CHAKRAVARTY: Now, this exhibit -- excuse me. So this Exhibit 1264, is this the subscriber information for the Al_FirdausiA account?

MR. CHAKRAVARTY: Does it list the person who -- the name of the person who opened this account?

MR. CHAKRAVARTY: So how do you know who that person is based on this information?

STEVEN A. KIMBALL: That was through subscriber information of the Gmail that is listed there.

MR. CHAKRAVARTY: So there's an email address associated with the Twitter account?

MR. CHAKRAVARTY: That's this email address here I just circled, Tsar1Jahar@gmail.com?

MR. CHAKRAVARTY: Subsequently, did you obtain -- actually, did you separately obtain from Gmail, which is the Google's email service, the subscriber information to that account?

MR. CHAKRAVARTY: Was that, in fact, subscribed to Jahar Tsarnaev?

STEVEN A. KIMBALL: Yes. It came back to the defendant.

MR. CHAKRAVARTY: And the date that this account was created, is that listed here that I just underlined in red?

MR. CHAKRAVARTY: That's March 11, 2013?

MR. CHAKRAVARTY: Do you know what this means?

STEVEN A. KIMBALL: That is the creation IP.

MR. CHAKRAVARTY: Do you know, in laymen's terms, what an IP is?

STEVEN A. KIMBALL: Internet Protocol. Essentially, it's the address on the internet where that was created.

MR. CHAKRAVARTY: Are you familiar with where this internet protocol address resolves to?

STEVEN A. KIMBALL: Yes. It resolves back to the University of Massachusetts Dartmouth.

MR. CHAKRAVARTY: Back to 1274.

MR. CHAKRAVARTY: Is this similarly the subscriber information that Twitter provided with regards to the J_tsar Twitter account?

MR. CHAKRAVARTY: And is this the email address associated with the account?

MR. CHAKRAVARTY: And did you also apply for a search warrant for -- excuse me. Did someone apply for a search warrant for the contents of that account?

STEVEN A. KIMBALL: Yes, they did.

MR. CHAKRAVARTY: And was that -- did that account also come back to Jahar Tsarnaev?

STEVEN A. KIMBALL: It did. It came back to the defendant.

MR. CHAKRAVARTY: And this IP address, are you familiar with that?

MR. CHAKRAVARTY: Where did that resolve to?

STEVEN A. KIMBALL: That also resolves back to the University of Massachusetts Dartmouth.

MR. CHAKRAVARTY: And this account was created back in 2011; is that fair to say?

MR. CHAKRAVARTY: All right. So I'm going to ask you now to go through some of the tweets or the posts on this account, the J_tsar account, that were observed after the bombing. Do you know approximately how many tweets there were on that account?

STEVEN A. KIMBALL: There are approximately 1,100.

MR. CHAKRAVARTY: We don't have all 1,100 today, right?

MR. CHAKRAVARTY: There are just a select few that we selected?

MR. CHAKRAVARTY: Can we call up Exhibit 1320 -- excuse me. 1320, please, yes. I'm sorry, 1313, we'll start.

MR. CHAKRAVARTY: Now, is this one of the tweets that was extracted from the publicly available Twitter account of J_tsar?

MR. CHAKRAVARTY: Was this tweet also within the contents of the search warrant we were talking about?

MR. CHAKRAVARTY: Was that true for all of the tweets that we've looked at that you're going to present to the jury?

MR. CHAKRAVARTY: And so is it fair to say that Exhibits 1274 -- excuse me, 1275 through 1320 are all fair and accurate renditions of the tweets posted on the J_tsar account and the Al_FirdausiA account?

STEVEN A. KIMBALL: Yes, they are.

MR. CHAKRAVARTY: I'd move into evidence Exhibits 1275 through 1320.

MR. CHAKRAVARTY: If I could publish, your Honor?

MR. CHAKRAVARTY: Agent Kimball, is this the first tweet on the J_tsar account that occurred after the Boston Marathon bombing?

MR. CHAKRAVARTY: Just to orient the jury on the contents of this page, can you describe the various features of what appears on this page?

STEVEN A. KIMBALL: Sure. The first thing you're going to look at is the user name, or Twitter handle is another commonly-used term. That's the @J_tsar. Then you have the display name, which is Jahar, J-a-h-a-r. And then you have a display picture, which in this case is a lion. That's essentially it.

MR. CHAKRAVARTY: Now, the -- this was put on for purposes of the presentation to the jury, is that right?

MR. CHAKRAVARTY: So this content -- to explain how Twitter works, is this a message that the user of the account types into the account?

MR. CHAKRAVARTY: And then that is visible by everyone?

MR. CHAKRAVARTY: And this date and time that appear, did you determine what time zone that time is from?

STEVEN A. KIMBALL: That time zone is Pacific Standard Time.

MR. CHAKRAVARTY: Was that compared to the results of the search warrant to determine that?

MR. CHAKRAVARTY: So Pacific Standard Time is three hours behind Eastern Standard Time, is that right?

MR. CHAKRAVARTY: So at around 8 p.m. Eastern Standard Time, is it fair to say this tweet was made?

MR. CHAKRAVARTY: And can you read it, please?

STEVEN A. KIMBALL: "Ain't no love in the heart of the city, stay safe, people."

MR. CHAKRAVARTY: 1314, please.

MR. CHAKRAVARTY: Agent Kimball, are you familiar with when, before a tweet goes out, that there is an @ and then the name of another user, what that means in Twitter language?

STEVEN A. KIMBALL: Essentially, you're directing that tweet or message at that user.

MR. CHAKRAVARTY: Do other people who surf to this account get to see that tweet?

MR. CHAKRAVARTY: So it's not a private message?

MR. CHAKRAVARTY: 1315, please. And 1316.

MR. CHAKRAVARTY: Can you read this message, please?

STEVEN A. KIMBALL: "There are people that know the truth but stay silent & there are people that speak the truth but we don't hear them cuz they're the minority."

MR. CHAKRAVARTY: Now, this tweet was at 12:34 on April 16th, is that right?

MR. CHAKRAVARTY: And that's because I added three hours to this number up here, right?

MR. CHAKRAVARTY: Back to 1315. I didn't mean to ignore this. Now, is this a tweet from the J_tsar account?

STEVEN A. KIMBALL: No. That is a tweet that the J_tsar account is responding to.

MR. CHAKRAVARTY: So the user of this account responded to this tweet?

MR. CHAKRAVARTY: I'm sorry. Is there a second page to this? No. Sorry. Is there a first page? 1314, please. Is there a second page to that? Go back to 1315.

MR. CHAKRAVARTY: Do you remember what the J_tsar tweet was related to this account -- related to this post?

STEVEN A. KIMBALL: The J_tsar tweet in regards to this was essentially -- "fake story" was the response that was tweeted out to this story.

MR. CHAKRAVARTY: So the user of J_tsar wrote "fake story"?

MR. CHAKRAVARTY: Exhibit 1317, please.

MR. CHAKRAVARTY: Now, is this a tweet from April 16th, at approximately 1:22 p.m.?

MR. CHAKRAVARTY: Can you read that, please?

STEVEN A. KIMBALL: "So then I says to him, I says, relax bro my beard is not loaded."

MR. CHAKRAVARTY: And Exhibit 1318. Sorry.

MR. CHAKRAVARTY: Is this the tweet I was referring to earlier --

MR. CHAKRAVARTY: -- that you already described?

MR. CHAKRAVARTY: Exhibit 1319, please.

MR. CHAKRAVARTY: Can you read this?

STEVEN A. KIMBALL: "Nowadays everybody wanna talk like they got somethin to say but nothin comes out when they move their lips; just a bunch of gibberish."

MR. CHAKRAVARTY: Agent Kimball, did you learn what this is?

STEVEN A. KIMBALL: This is basically lyrics to a rap song.

MR. CHAKRAVARTY: Again, this is April 16, the day after the Marathon bombing?

MR. CHAKRAVARTY: Agent Kimball, is this the last tweet authored by the user of J_tsar?

MR. CHAKRAVARTY: And can you read it?

STEVEN A. KIMBALL: "I'm a stress free kind of guy."

MR. CHAKRAVARTY: Now, before the Marathon bombing, were there -- I think you described there are over a thousand tweets, is that right?

STEVEN A. KIMBALL: Yes, approximately.

MR. CHAKRAVARTY: Can we go to Exhibit 1312, please? Now, this is the last tweet from the J_tsar account before the Marathon bombing; is that fair to say?

MR. CHAKRAVARTY: This is close to midnight on the night before the bombing, 11:39 p.m.?

MR. CHAKRAVARTY: And was this a message to another person with this user name?

MR. CHAKRAVARTY: Go to 1313, please. Sorry. 1311, please.

MR. CHAKRAVARTY: Two days before the bombing, was there this message?

MR. CHAKRAVARTY: And, again, is this to a specific person using @Kid_Wavyy?

MR. CHAKRAVARTY: Can you just read it?

STEVEN A. KIMBALL: "@Kid_Wavyy, yea man never get into a family plan with foreigners."

MR. CHAKRAVARTY: Do you know what that means?

MR. CHAKRAVARTY: Exhibit 1310, please.

MR. CHAKRAVARTY: This is on April 10th, which is just before the weekend, the week before the bombing, I think the Thursday. Can you read this one?

STEVEN A. KIMBALL: "Most of you are conditioned by the media."

MR. CHAKRAVARTY: 1309, please.

STEVEN A. KIMBALL: "If you have the knowledge and the inspiration all that's left is to take action."

MR. CHAKRAVARTY: This is a little over a week before the Marathon bombing, is that right?

STEVEN A. KIMBALL: "You have to make tough decisions today and those decisions will influence your future. Hardships will arouse and you will role up loud.

MR. CHAKRAVARTY: Now, in Twitter language, what does something that appears after a hashtag mean?

STEVEN A. KIMBALL: A hashtag is basically a way to wrap a conversation around a certain topic, or you can also search by a hashtag. So if you want to view individuals who have also posted under that same hashtag, you can search that hashtag and view those postings.

MR. CHAKRAVARTY: Now, this was on March 14 of 2013?

MR. CHAKRAVARTY: I'm sorry. Agent Kimball, was this post on March 14 of 2013?

MR. CHAKRAVARTY: Exhibit 1302, please.

MR. CHAKRAVARTY: Can you read this one?

STEVEN A. KIMBALL: "Never underestimate the rebel with a cause."

MR. CHAKRAVARTY: Now, this post was on March 10, 2013, at about three minutes before midnight, is that right?

MR. CHAKRAVARTY: Now, the Al_FirdausiA account, on that same day, into the next day, did you see activity on that account from that day?

STEVEN A. KIMBALL: Activity on that account, the Al_FirdausiA account, occurred approximately three hours after this tweet.

MR. CHAKRAVARTY: Were the Al_FirdausiA tweets that you matched up with the results of the search warrant -- were those Exhibits 1273 through -- sorry, 1267 through 1273?

MR. CHAKRAVARTY: Sorry. Were those -- did those also match up -- the content of the search warrant matched what you saw that was publicly available?

STEVEN A. KIMBALL: Yes, they did.

STEVEN A. KIMBALL: Ghuraba, roughly translated, means stranger or strangers.

MR. CHAKRAVARTY: Is that the handle -- or the screen name, excuse me?

MR. CHAKRAVARTY: So is it reverse chronological order so the most recent tweet is at the top?

MR. CHAKRAVARTY: Here I think you mentioned earlier that this account followed the J_tsar account. In fact, on the screenshot, does it say, "Ghuraba followed Jahar," amongst others?

STEVEN A. KIMBALL: Yes, it does.
